The Legal Process In Florida

When a couple is married at the time of their child’s birth, the law assumes they are both the parents and do not need to take any legal action. If the couple is not married, however, they have several methods for establishing paternity in Florida, including:

  • Acknowledgment – If both parents are unmarried at the time of a child’s birth, they can agree to sign a legal acknowledgment identifying the man as the legal father.
  • Legitimation – If both parents are unmarried at the time of a child’s birth, but later get married, the law will assume the husband to be the legal father. The parents need to file documents to add him to the child’s birth certificate.
  • Court order – Either party may petition the court to determine paternity. The petitioning party then serves notice on the other party. A judge will hear evidence and decide whether to require a genetic test to prove paternity.
  • Administrative order – If a paternity test reveals that a man is the father of a child, he may receive an administrative order that legally establishes paternity.

When you meet with Ms. Gordon, she will go through each necessary step in your paternity case with you and explain the method that best fits your situation.
